This is an educational illustration, not a valuation of your claim or legal advice. Insurers and courts are not required to use either method. Fault, policy limits, state law, and the strength of your evidence can change the result a great deal.

How This Calculator Works

Settlement estimates generally combine two buckets. Economic damages are the dollars you can document: medical bills (past and expected future), lost wages from missed work, and out-of-pocket costs like towing, rental cars, and prescriptions. Non-economic damages — often called pain and suffering — compensate for physical pain, emotional distress, and how the injuries changed your daily life.

For pain and suffering, the calculator shows the two methods insurers commonly discuss: the multiplier method (medical bills multiplied by a factor that rises with injury severity) and the per diem method (a daily dollar amount for each day of recovery). Neither is a legal standard — they are starting points for negotiation, which is why the result is a range, not a single number.

Why Your Actual Settlement May Differ

  • Fault: in most states, being partly at fault reduces what you can recover — in a few, it can bar recovery entirely.
  • Policy limits: the at-fault driver's insurance caps what their insurer will pay, regardless of your losses.
  • Evidence: medical records, photos, witness statements, and consistent treatment make claims stronger.
  • State law: no-fault rules, damage caps, and filing deadlines vary by state.
