Questions for Evaluating a Digital Evidence Lead

From our guide Commercial Vehicle Accident Evidence Checklist: What to Save and Who to Ask

  • Who told you the recording or data exists, and when did they tell you?
  • Is this an actual file you possess, or only a possible source to investigate?
  • What exact vehicle, entrance, roadway, or time period might the source capture?
  • Does the displayed timestamp match the crash time, or is that still uncertain?
  • Have you saved the source's contact information without accessing restricted systems?
  • Has anyone mentioned deletion, equipment replacement, or loss of account access?
  • Have you told counsel whether the source may be a party to the claim?
  • If you received a clip or screenshot, have you identified who supplied it and whether a fuller original may exist?
